Terms of Service (Public Offer) for the Levsha Platform

Document 1. Public Offer

This document constitutes an official offer (public offer) made by individual entrepreneur Kulishova Rusiyana Sergeevna (hereinafter — the "Service Provider"), addressed to any individual or legal entity (hereinafter — the "User"), to enter into an agreement on the use of the "Levsha" software platform (hereinafter — the "Service") on the terms set out below.

1. Subject of the Agreement

  1. 1.1. The Service Provider grants the User a simple (non-exclusive) license to access the Service's features, including tools for creating and editing video, images, and audio using artificial intelligence (AI) technologies.
  2. 1.2. Access to the Service's features is provided on a paid basis through the User's purchase of a Subscription and/or prepaid packages of the internal accounting unit — "Credits".

2. Settlement and Service Delivery

  1. 2.1. The Service Provider's services are deemed rendered in full and of proper quality at the moment "Credits" are added to the User's internal balance or at the moment the Subscription is activated, regardless of whether the User has actually used the Service's features.
  2. 2.2. "Credits" are debited for the act of submitting a request to neural network computing resources via the Service interface.
  3. 2.3. Refunds. The Service Provider provides access to AI tools "as is" (AS IS). The result of content generation by a neural network is probabilistic in nature. A mismatch between the generated content and the User's artistic expectations, or the presence of visual artifacts or distortions, does not constitute grounds for a refund or compensation of debited "Credits".
  4. 2.4. Refunds of debited "Credits" to the internal balance are possible only in the event of a systemic technical error (server error) which prevented content generation from completing.

3. Liability of the Parties

  1. 3.1. The User bears full responsibility for any source materials (text prompts, uploaded images, references) submitted to the Service for content generation.
  2. 3.2. Use of the Service to create content that violates the laws of the Russian Federation is prohibited, including but not limited to: creation of pornographic materials, propaganda of violence, creation of "deepfakes" for fraudulent purposes, and infringement of third-party copyrights.
  3. 3.3. In the event of a violation of clause 3.2, the Service Provider has the right to block the User's account without refunding any funds.
